Amended returns serve a very important function in compliance with the income tax federal and state legal requirements. They offer a procedurally easy way to modify your previous federal tax returns filed with the IRS. For individuals, the IRS uses form numbered/coded 1040X. Each state requires a separate filing of Amended Tax Returns (separate from the one sent to the IRS). For example, State of New Jersey uses form NJ-1040X. The taxpayer has 3 years from the filing deadline (from deadline of April 15) to get an additional refund, assuming that missing tax deductions and tax credits were identified.
Business tax returns, such as income tax returns forms 1120 (for Corporations), 1120-S (special election for pass-through corporate entities) and 1065 (for partnerships) and well as Schedule C (part of individual tax return) for sole proprietors and Single Members LLC companies, can also be amended. The same refers to payroll tax returns, such as Federal forms 941 and 940). Similar to the IRS, all states allow to submit Amended Tax Returns for previously field income tax or payroll tax returns.
